This document defines the conditions applicable to sales concluded between on the one hand, people wishing to purchase products via the website http://dayna.fr, hereafter referred to as the "Client" and on the other hand the company Color of India sarl, which registered address is 24 rue de Dunkerque, 75010 Paris, registered under number 482 004 322, with a registered capital of 7,650 Euros, VAT number FR28482004382, hereafter referred to as "Dayna". This information only applies to individual customers purchasing the products for their own private use.

The general structure, texts, animated and other images and any and all elements making up this website are protected under French and international laws related to intellectual property and copyright.
All rights of reproduction are reserved, including for any downloads and iconographical or photographical representations.
Color of India is the sole owner of any and all copyrights and intellectual property rights on the general structure, texts, animated and other images, trademarks, logos and any other elements making up this website.
It is expressly forbidden to reproduce, whether partially or totally, this website and/or any part thereof without the prior express written consent of Color of India.
Any representation or reproduction of this website by any process constitutes an infringement.

3 - Links

The hypertext links implemented in this website in direction of other resources available on the worldwide web shall not engage the responsibility of Color of India in any manner, in particular any responsibility whatsoever relating to the content of any direct or indirect resources.
Color of India is not responsible for any hyperlinks which may point to this website and expressly forbids any hyperlink which has been implemented without its prior express written consent.

4 – Prices

All the prices of the products are indicated in Euros, all taxes included, except participation to the shipping costs (see article 6: Shipment and Delivery). Dayna.fr reserves the right to modify any price at any time without prior notice. Products shall be invoiced according to the applicable price at the time of validation of the order. The products remain the property of dayna.fr until complete payment of the purchase price. The price is payable in a single total installment.

5 – Order

The client may order on internet via the website dayna.fr.
Dayna.fr reserves the right to cancel or refuse any order by any client with whom a dispute over payment of a prior order exists, or who represents in its view any kind of risk. An order represents agreement to the prices and descriptions of available products. Dayna.fr agrees to supply all orders received via the website only if available inventory so permits. In case of unavailability of one or more products contained in an order, dayna.fr shall inform the client thereof in a timely manner. The order shall be correspondingly cancelled and any amounts received promptly returned to the client.

6 – Shipping and Delivery

Any order taken via the website shall be prepared and shipped within one week, on condition that the payment has been validated (see article 7:  Payment). Shipping times shall vary according to the destination and shall be advised by the e-mail confirming the order.

7 – Payment

Payment of purchases shall be made exclusively by bank card or credit card.
Payment shall be accepted upon receipt of any additional information required in the case of payment by bank or credit card requiring further information.
Dayna.fr reserves the right to verify the personal information supplied by the client and to adopt any measures deemed necessary to verify that the person whose account is debited is the real purchaser of the products, in order to avoid any fraudulent payment. This verification may take the form of a request to supply the client’s name and address, or a request for bank identification. In the case of no reply by the client within 2 days of dayna.fr’s request, the corresponding order shall be automatically cancelled, without any possibility of further claims in this regard.
Dayna.fr is also entitled to cancel any order which may represent, in its sole opinion, any risk of fraud.

8 – Returned or refunded products

8.1 Product returns: Subject to the terms below, the client may exercise its right to return the products within a 7-day period from the receipt of the products. The returned products must be new, unused and in their original unopened packaging.
Returns can only take place after a return request has been made by the client to infos@dayna.fr. Returns shall be made by colissimo with countersignature requested. All shipping charges are borne by the client. The client shall keep the shipping receipt handed over to him by the Post Office. In the case of a lost package, no refund shall be made without this shipping receipt.
Upon receipt of the package, dayna.fr shall be sole judge of the proper state of the returned products. No return shall be accepted if the products are visibly used or damaged and this renders them unable to be sold. If the products are refused by dayna.fr, they shall be returned to the client at the expense of dayna.fr, without any other recourse being available to the client, except his rights under product liability rules.
8.2- Product refunds: Subject to a proper return of the products, 
Dayna.fr shall automatically refund the returned products within 15 days of their being put back into the inventory. In case of returned products which do not respect the conditions for their refund, dayna.fr reserves the right to exercise any recourse against the client with a view to receiving a total refund of any costs incurred.

9 – Security of transactions

Dayna.fr has implemented adequate measures to ensure that any data transmitted via the web or the website shall remain confidential and secure. In this regard, dayna.fr uses a SSL (secure socket layer) secure payment module via the PAYBOX system.

11 – Liability

For all steps of access to the website, the order process, delivery or customer service or any other service, dayna.fr shall only be required to make its best efforts. Furthermore, dayna.fr shall have no liability in case of inconvenience or damages resulting from the use of the internet network, in particular in case of interrupted access, outside intrusion or the presence of any virus or any event qualified as an act of God, according to existing applicable laws.

12 – Nominative details

Dayna.fr reserves the right to collect data regarding the client. This data shall in no event be provided to any third party.
As provided by the law of January 6, 1986 regarding individual rights and the internet, the client shall dispose of a permanent right of access, rectification and opposition to the entire information related to him, which he may exercise in writing, by post and with proof of identity sent to Color of India, 24 rue de Dunkerque, 75010 PARIS, France.
